2022 was a unique year for Canada’s Express Entry immigration system and an overview of Canada’s express entry system 2022. The all-program draws were on pause for the opening six months of 2022 and then resumed for five more months until a technical issue caused them to be suspended once again. Only late 2022 showed signs of the Immigration, Refugees and Citizenship Canada’s (IRCC) application backlog being reduced significantly.    After seven years of steady growth since the system’s inception in 2015, this was the first year that saw a complete halt. That being said, it is only provisional as record immigration levels have been forecasted for the coming three years and are expected to increase to 500,000 annually by 2025. Consequently, the Express Entry immigration system will likely come back with greater vigor in 2023 when Canada attempts to battle its constant labor shortage.   The backlog of Express Entry applications started to clear out in the second half of 2022. The Canadian government has committed even more funds to clear the backlogs, thus it is expected that they will decrease even more significantly in the next year.    The introduction of an updated National Occupational Classification System in 2022 was another significant development. The National Occupational Classification (NOC) System was updated during the year. The Provincial Nominee Programs have been modified to work with the new TEER system, which now assigns vocations a five-number code instead of a 4.   The NOC system is used by Immigration, Refugee, and Citizenship Canada (IRCC) to establish a candidate’s eligibility for Express Entry. Express Entry profiles can only currently be submitted by candidates who have NOC skill types A, B, or 0 of work experience. Jobs in TEERs 0, 1, and 3 will be eligible for Express Entry programs under the new system. It effectively means that in advance of the introduction of occupation-specific draws in early 2023, officials and employers will be better able to identify the employees they want. All of the newly added occupations, which were included in the Federal Skilled Worker Program when NOC 2021 was introduced in November 2022, are mentioned in full below: Payroll administrators; Dental assistants and dental laboratory assistants; Nurse aides, orderlies, and patient service associates; Pharmacy technical assistants and pharmacy assistants; Elementary and secondary school teacher assistants; Sheriffs and bailiffs; Correctional service officers; Bylaw enforcement and other regulatory officers; Estheticians, electrologists, and related occupations; Residential and commercial installers and servicers; Pest controllers and fumigators; Other repairers and servicers; Transport truck drivers; Bus drivers, subway operators, and other transit operators; Heavy equipment operators; and Aircraft assemblers and aircraft assembly inspectors.   Express Entry immigration system Using the Express Entry immigration system to enter the country is the process of submitting an application for skilled immigrants who wish to live permanently in Canada and contribute to its economy. The Express Entry immigration system is the fastest and most popular route for immigrants looking to start over in Canada. Every year, Canada welcomes over 110,000 skilled workers under the Express Entry immigration system. The three economic programs can be used by prospective immigrants who want to immigrate to Canada: Federal Skilled Worker Program (FSW) Federal Skilled Trades Program (FST) Canadian Experience Class (CEC).   If an applicant meets the requirements of the Express Entry immigration system, they may submit the required supporting documents and upload a profile on the IRCC website. The candidates will then receive a Comprehensive Ranking System (CRS) score, which is used to compare each candidate in the application pool. The probability of receiving an Invitation To Apply (ITA) for permanent residence rises with higher test scores.   Number of ITAs As per ministerial instructions, Express Entry applicants received 46,538 ITAs during the period of the 23 draws in 2022. These figure covers draws held between January and July just for participants in Provincial Nominee Programs (PNPs). There were 35,750 ITAs in total for just all-program draws, which started in July and continued through the rest of the year. Honorable Sean Fraser, the minister of immigration, stated in April of last year that all-program Express Entry draws would start up again in July. At the first draw, which was held on July 6, 1,500 applicants attended.   Due to the gap in drawings of the Express Entry immigration system in the first half of the year, there are fewer ITAs overall than in the past. The smallest draw occurred on July 6. Canada to Implement Updated Immigration Appeal Division in January 2023

Starting on January 14, 2023, the Immigration Appeal Division (IAD) will launch new regulations to replace the old rules established in 2002. The new regulations reflect key changes to immigration appeals, including the time limit for submitting an appeal record and disclosing papers supporting an immigration appeal.    Introducing these new immigration appeals regulations is intended to modernize the appeal process and guarantee that the Immigration Appeal Division (IAD) handles all matters fairly, justly, and in compliance with existing legislation.   Changes to have come in the immigration appeal division Some of the most significant changes the new Rules make to the appeals process are described here. Once the updated IAD Rules are announced in the upcoming weeks’ Canada Gazette.    Time limits for submitting an appeal record  The Minister has now 60 days to deliver the appeal record in cases involving sponsorship and residency requirements. In the previous Rules, it was 120 days. The Immigration Division or the Minister now has 30 days to provide the appeal record for the Minister’s appeals and appeals of removal orders. In the previous Rules, it was 45 days.   The time limit for disclosing papers in support of an Immigration appeal There is a deadline for releasing documents in support of an immigration appeal. After getting the appeal record, a party has 60 days to provide any supporting documents (Rules 24(1) and 26). In the previous Rules, a hearing wasn’t until 20 days later. In accordance with Rules 24(2) and 26, a party must inform the IAD within the same 60-day period if they do not intend to submit any documents to support their appeal. The Rules specify new consequences, such as declaring the appeal abandoned, if a party fails to provide any documents or informs the IAD that no documents are being provided (Rule 30). A party now has 30 days before a hearing to submit documents in response to evidence provided by the other side (Rule 27). In the previous Rules, there were ten days before a hearing. If a party submits a document after the deadline has passed, the Division must take new factors into consideration before deciding whether to allow the party authorized to use the document (Rule 29).   Other Important Changes to Immigration Appeals  From 20 to 30 days before the hearing, a party now has more time to provide witness information. There is a new requirement that the witness information now provides a brief summary of the purpose and content of the testimony (Rule 55). The documents used in an informal settlement process are no longer private and may be used in a future appeal. However, all information handled during an informal settlement process is kept private (Rules 66 and 67). The criteria used to decide whether to grant an application for a change in a procedure’s date or time have changed. An application to adjust the date and time must be submitted at least three working days before the proceeding, as opposed to two working days, unless it is for medical reasons (Rules 90 and 91). The procedures for conducting a hearing are now defined in the new Rules 74 to 76. Ontario to start foreign-trained doctor CRP in 2023 via Practice Ready Assessment

Ontario to launch a foreign-trained doctor credential recognition program in 2023 via Practice Ready Assessment (PRA) programs. By next spring, the College of Physicians and Surgeons of Ontario (CPSO) could introduce a three-month program to recognize foreign medical credentials in Ontario. This year, the self-governing body for Ontario’s medical professionals submitted a proposal to the province’s Ministry of Health, a 12-week program designed specifically for internationally trained physicians in Ontario. Practice Ready Assessment (PRA) programs in seven Canadian provinces help foreign-trained physicians who have previously finished their training and practiced overseas.   With the help of supervision and direct observation, the CSPO would be able to:  Analyze the qualifications of physicians with foreign education over the course of 12 weeks. Employ competent candidates in underserved populations. Provide these medical professionals with a route to independent licensing.   In its submission to Ontario Health Minister Honourable Sylvia Jones, the CPSO noted that, with government funding and coordination among key system partners, the program could be put into action right away. This would help to start a new supply of internationally trained physicians into the system as early as spring 2023 and onward.   What is Practice Ready Assessment? The Practice-Ready Assessment (PRA) programs from the National Assessment Collaboration (NAC) are available in seven provinces throughout Canada as a path to licensing for foreign medical professionals who have already finished their residency and worked independently abroad.  Each participating province offers a practice-ready assessment Ontario PRA program where candidates work under supervision and are evaluated over the time of 12 weeks with the aim of obtaining an independent license to practice in Canada. This program is designed to ensure that International Medical Graduates (IMGs) and international physicians possess the clinical knowledge and skills required to provide quality patient care in Canada. With return-of-service commitments providing employment for qualified PRA applicants, the focus is on satisfying requirements in Canada’s rural and remote areas.   How does medicine work in Canada? According to experts, increasing the number of residencies available to physicians with international training will help to address the issue of a medical labor shortage. An applicant must have successfully finished a bachelor’s degree and graduated from a Canadian-accredited medical school in order to practice medicine in Canada. The Medical Council of Canada Qualifying Examination Part 1 and the National Assessment Collaboration Examination must be passed by applicants who have just graduated. They must use CaRMS to apply for a post-graduate residency space as well as a work permit for Canada. Five new occupations added to Global Talent Stream

On December 22, 2022, the Employment and Social Development department Canada (ESDC) extended the Global Talent Stream profession list from 12 to 17 occupations. The five newly-added engineering positions will allow more global talent to be recruited into the country.  The new eligible occupations are:  Civil Engineers (NOC 21300); Electrical and electronics engineers (NOC 21310);  Mining engineers (NOC 21330);  Aerospace engineers (NOC 21390), and  Computer engineers (NOC 21311).    Through the GTS, employers can quickly and efficiently apply for a work permit to hire skilled foreign workers in 17 of the most sought-after professions.   Employment and Social Development department Canada (ESDC) The federal labor market and social programs are managed by Employment and Social Development Canada (ESDC), a department of the Canadian government. The department manages a number of federal government programs and services, including the federal labor program, Service Canada centers, Canada Student Loan Program (CSLP), Canada Pension Plan (CPP), issuing social insurance numbers (SIN), and Employment Insurance (EI).   Global Talent Stream The Global Talent Stream provides fast, responsive, and predictable client-focused assistance to access highly-skilled global talent to expand Canada’s workforce and to be competitive on a global scale. This Stream, which is a part of the Temporary Foreign Worker Program, is created for Canadian businesses that are referred to Employment and Social Development Canada by a designated referral partner and that require unique and specialized foreign nationals in order to scale up and grow. Canadian employers increase wages to attract more workers As Canada is facing a shortage of workers, employers have taken the initiative to offer higher wages to attract more workers. According to the latest Statistics Canada report, the average hourly wage has risen by 7.5% since last year, amounting to $24.20 per hour.    The job vacancy rate is the ratio of vacant positions to total labor demand, encompassing both filled and open positions. With job openings rising and salaries rising accordingly, it is an ideal time for those seeking new employment opportunities in Canada.   Several categories of in-demand occupations saw rises in offered salaries that were even higher than the national average, including:   Middle management in the production, transportation, and utility sectors had an hourly wage increase of 10.8% to $41.40.   Occupations that support healthcare by offering support (+10.7% to $22.45 per hour).   Manufacturing assemblers (+10.4% to 20.05 per hour); and   Machine operators and other production staff have seen an increase in pay of 10.2% to $20.02 per hour.   The demand for health care and social services has remained incredibly high ever since the Covid-19 pandemic. With over 150,100 open healthcare jobs in the third quarter of 2022,   The Canadian government took steps to make it simpler for healthcare professionals to move to Canada in order to address this issue. Targeted Provincial Nominee Program (PNP) Draws have been conducted throughout 2022 to welcome foreign medical professionals and make it simpler for physicians to apply for Permanent Residence through Express Entry. Currently, one in four healthcare professionals in Canada is an immigrant, according to the IRCC.   Significant numbers of open positions were also reported in other industries. Vacancies for professional and scientific services, construction, and food and lodging services were relatively high. In the construction industry, there were 81,100 positions open, matching the record level from the previous quarter. Carpenters and laborers were the most in demand.   Provinces in Canada with the most job vacancies  Job openings increased in Saskatchewan and Manitoba by 7.5% and 10.7%, respectively, in the third quarter of 2022.  The highest job vacancy rates are in British Columbia and Quebec, where they are 6.2% and 5.8%, respectively, and are steadily rising. OINP invited 14 business candidates under the Entrepreneur Stream

Ontario Immigration Nominee Program (OINP) released the results of the new draw under the Entrepreneur Stream. Province invited 14 business candidates to this draw, on December 22, 2022, The minimum score of this round was 140, two points more compared to the August 16 draw. The OINP noted that those whose Expressions of Interest were scored by December 15, 2022, were eligible for this draw. This year, the Government of Ontario invited 96 business candidates to apply for the provincial nomination.   Entrepreneur Stream Overview The Ontario Immigrant Nominee Program has an immigration stream named the Entrepreneur Stream (OINP). It was created in accordance with the 2015 Ontario Immigration Act and its regulations. This stream is for entrepreneurs from outside Canada who want to launch a new business or acquire an existing company in Ontario. When a firm is created in Ontario, it provides an entrepreneur the chance to be nominated for permanent residence. There are two stages to applying for the Entrepreneur Stream. Stage1:  submit an expression of interest. submit an application if selected. You must appear in person for a required interview with your business partner, if applicable. You must sign a performance agreement if your stage 1 application is approved. Stage2: Ontario offers you a letter of support for a temporary work permit so you can submit an application to IRCC. Establish your business: You have 20 months from the day you arrive in Ontario to put your business plan into action and submit a final report. Ontario asks for paperwork to confirm that you are qualified for nomination for permanent residence if your company satisfies all requirements.   Ontario Immigration Nominee Program The province’s program for economic immigration is named the Ontario Immigrant Nominee Program (OINP). Immigration, Refugees and Citizenship Canada, works with the government of Canada (IRCC). Foreign workers, foreign students, business candidates, and individuals with the required education, training, and experience submit nomination applications to the OINP.   People with the knowledge and experience that the Ontario economy requires are identified by the OINP and nominated for permanent residency; however, the final decision to grant applications for permanent residence belongs to the Government of Canada. Under the Entrepreneur Stream, you must be invited before you may submit an application for nomination for permanent residence in Canada. The registration of an EOI is free. Ontario issued 725 invitations through the Master Graduate Stream on December 21, 2022, Ontario Immigration Nominee Program (OINP) issued 725 invitations to apply (ITAs) to potential candidates in the Expression of Interest system pool for the Master Graduate stream. The minimum score of this round was 46 points, 11 points more than in the previous program-specific draw.    This was the highest score for the stream in 2022. The profiles of selected candidates were created between November 22, 2022, and December 21, 2022. In 2022, the province invited 3,890 candidates under this stream. Before you can submit an application to be nominated by the Ontario government for permanent residency, you must first register in the OINP’s Expression of Interest System and get an invitation to apply.    Masters Graduate stream Requirements You can apply to the Master’s Graduate stream once you’ve been invited to do so. For your application to be granted, you must meet each requirement in the categories below.   Expression of interest and invitation to apply Invitation to apply an expression of interest You must have been invited to apply and submit your application by the deadline.  You must provide proof that you have the qualifications you stated in the expression of interest that you submitted to the OINP and attested to. Links to Ontario Candidates must provide proof of past Ontario residency in order to be eligible for the Ontario Masters Graduate program. Successful candidates must show that they have lived in Ontario for at least 12 of the previous 24 months. language ability The Canadian Language Benchmark (CLB) level 7 is the minimum language competency score required for the Master’s Graduate program in either English or French. Education Level Candidates must have earned a master’s degree from an Ontario university within the last two years in order to be eligible. Settlement Funds Immigration, Refugees and Citizenship Canada has set the settlement funds requirement for all applicants to the Ontario Masters Graduate stream (IRCC). This can be demonstrated by looking at their own finances or by keeping a job offer that is still in effect. Ottawa introduced a new update regarding the LMIA exemption codes on December 16, 2022, the Government of Canada introduced a new program delivery update regarding the labor market impact assessment (LMIA) exemption codes under the International Mobility Program (IMP).    According to the update, the government added new LMIA-exemption codes to GCMS and the Employer Portal and changed individual country free trade agreement codes. Some LMIA-exemption codes also have now newly created codes for the different categories. In addition, exemption codes have been amended on the instruction pages, and where further updates are in process, a flag has been added to alert the immigration officers.   LMIA exemption codes The Immigration and Refugee Protection Regulations (IRPR) Sections 204 to 208 give the regulatory authority to grant a work permit to an individual who is exempted from the need for a labor market effects assessment (LMIA).  Immigration, Refugees and Citizenship Canada (IRCC) has policies that define certain conditions as compliant with sections 204 through 208 of the IRPR. In order to record the different eligibility requirements or criteria for those individual conditions, the Department has created LMIA exemption streams (through special administrative codes). There is a list of LMIA exemption codes. A25.2 Public policies R204: International agreements or arrangements R205: Canadian interests R206: No other means of support R207: Permanent residence applicants in Canada R207.1: Vulnerable workers R208: Humanitarian reasons International Mobility Workers Unit (IMWU): port of entry (POE) assistance   The International Mobility Program (IMP) Employers in Canada are able to hire foreign workers on temporary work visas according to the International Mobility Program (IMP), which excludes the need for a Labour Market Impact Assessment (LMIA). This could have a lot of benefits for both employers and employees, who would like a simpler, quicker hiring process. The International Mobility Program promotes Canada’s broader economic and cultural goals, in contrast to the Temporary Foreign Worker Program, which issues work permits based on the state of the labor market in particular conditions. The following positions are exempt from the LMIA requirement: Provide Canada-wide advantages in terms of its economy, culture, or other competitive factors, and give Canadian citizens and permanent residents benefit in return. The following types of workers are eligible for the International Mobility Program (IMP): Those who enter Canada in accordance with trade agreements like the Comprehensive Economic Trade Agreement (CETA) or the Canada-United States-Mexico Agreement (CUSMA) (CETA). Those entering Canada on an open work permit. Those entering Canada as intra-company transferees.   The foreign national will only be qualified to apply for their own work permit after completing these three processes. Only those who receive a valid Nova Scotia job offer may immigrate to Nova Scotia as an early childhood educator through the Atlantic Immigration Program or the Nova Scotia Nominee Program Skilled Worker Stream.   Nova Scotia Early Childhood Educators (ECE) Immigration pilot.  Skill type B is given to Early Childhood Educators (NOC 4214). They work in nurseries, kindergartens, special needs programs, and other places that are similar to childcare centers. Among the many job roles in this profession are: For children between the ages of newborn and 12, early childhood educators design, organize and carry out programs. Under the guidance of early childhood educators, early childhood educator assistants take care of infants and kids from preschool to elementary school. Children are led by early childhood educators and assistants who encourage and promote their growth from all perspectives, physical, and emotional—and who also make sure they are comfortable and protected. Early childhood educators may work as daycare providers, nursery school teachers, or other related positions in the Canadian labor market.   Atlantic Immigration Program In order to work and live in one of Canada’s four Atlantic provinces—New Brunswick, Nova Scotia, Prince Edward Island, or Newfoundland and Labrador—skilled foreign workers and international graduates from Canadian universities can apply for permanent residence through the Atlantic Immigration Program. The program helps employers in hiring people that need qualified individuals but can’t be fulfilled locally.   The requirements for the AIP are: Offer of employment from a business recognized by the AIP. legal status in the country of residence and a valid passport. Canadian high school diploma, or a foreign equivalent with an ECA. CLB 5 or higher on a language test in either official language. A reference letter with 1 year of work experience in a field related to Early Childhood Development. the desire to remain permanently in Nova Scotia and to live there.   Nova Scotia Nominee Program The Nova Scotia Nominee Program: Skilled Worker Stream was created to assist employers in finding qualified foreign workers and recent graduate international students. Employers are only allowed to hire foreign workers for positions that they have been unable to fill with Canadian citizens or permanent residents.
