rince Edward Island issued 136 invitations in June 2022

Prince Edward Island issued 136 invitations in June 2022

On June 16, 2022, Prince Edward Island conducted a new invitation round in the Prince-Edward-Island Provincial Nominee Program (PEI PNP). In the sixth round of the year, the province issued 127 invitations to apply to skilled workers in the Labour Impact and Express Entry streams.  PEI also invited 9 candidates to the Business Work Permit Entrepreneurs stream. The lowest score for business candidates was 65 points, 3 points more than it was in the May draw. This year, PEI invited 826 candidates. The next PEI PNP draw is scheduled for July 21, 2022. PEI PNP Express Entry Category Immigrants who wish to apply for provincial nomination under the PEI Express Entry Category must also be eligible for the Federal Skilled Worker Program (FSWP), the Federal Skilled Trades Program (FSTP), or the Canadian Experience Class (CEC). Candidates with Express Entry (EE) profiles must create an Expression of Interest (EOI) profile with the PEI PNP. An EOI profile announces to the provincial government that you wish to be considered for nomination. It also provides candidates with a score based on a provincial points grid. The highest-scoring candidates are assumed to receive an invitation to apply in the monthly draw. The candidates invited were issued to: Labor Impact and Express Entry stream Business Impact stream PEI Labor Impact Category 1) Skilled Worker Stream This employer-driven stream allows skilled workers with an employment offer in PEI to be nominated for Canadian Permanent residence if they meet the following criteria: A full-time employment offer from a Prince Edward Island business in an occupation classified as skill level “0”, “A” or “B” of the National Occupational Classification (NOC); Completion of post-secondary education, with a minimum of 14 years of formal education; Between 21 and 55 years of age; At least 2 years of full-time work experience in the past 5 years; Sufficient proficiency in English or French to occupy the employment offered; Sufficient settlement funds; Demonstrated intention to settle in PEI 2) Critical Worker Stream The critical Worker Stream category is developed to resolve labor shortages and is open to foreign workers already in PEI with employment in specific critical demand occupations. The primary criteria for nomination are: A full-time offer of employment from a PEI business in one of the following occupations: Customer service representative; Truck driver; Laborer; Food & beverage server; Housekeeping attendant. 6 months of work experience with the PEI business offering employment; Current valid Canadian work permit; High school diploma and minimum of 12 years of formal education; Between 21 and 55 years of age; At least 2 years of full-time work experience in the past 5 years; Demonstrate basic proficiency in English or French language; Sufficient settlement funds; Demonstrated intention to settle in PEI.  3. International Graduate stream IGS stream is for recent graduates from recognized accredited PEI-designated learning institutions (e.g., universities and colleges). Qualified applicants will work in a skilled profession in their field of study. Business Impact Category This Business Impact category is for eligible candidates who wish to establish, own, and operate a business in Prince Edward Island. To receive an invitation under PEI’s Business Impact Category, you have to apply under the Work Permit Stream. For this pathway, candidates are anticipated to begin working in Canada and learn about the business while on a work permit. Once the entrepreneur meets PEI’s criteria while on a work permit, they may be eligible to receive a provincial nomination in support of a permanent residence application to IRCC. It will not be an easy process to come to Canada maintaining every requirement alone for you. Do you need help? Post-Graduate Work Permit Program’s eligibility standards on humanitarian and compassionate grounds

Post-Graduate Work Permit Program’s Eligibility Standards on Humanitarian and Compassionate Grounds

The immigration court has ruled that visa officers do not have the discretion to alter the eligibility criteria of the Post-Graduate Work Permit Program (PGWP) on humanitarian or compassionate grounds. On June 14, 2022, reviewing the application of an applicant failing to fulfill the requirements of the PGWP, the Federal Court of Canada decided that even with the new evidence, the applicant would still have failed to satisfy the necessary criteria.  There is no law for the PGWP that confers discretion on an officer to alter or waive the eligibility requirements on humanitarian and compassionate grounds (HAG). Visa officials are not permitted to overlook any of the prerequisites for the approval of a PGWP. Humanitarian and compassionate grounds apply to people with exceptional cases. The Government of Canada evaluates these applications on a case-by-case basis. Factors looked at include: how settled the person is in Canada general family ties to Canada the best interests of the child, and what could happen to you if we do not grant the request. Other Rules Other rules for Post-Graduate Work Permit Program eligibility standards on humanitarian and compassionate grounds are given below: We will not assess risk factors such as persecution, the risk to life, cruel and unusual treatment, or punishment. You cannot have more than one HAG application at the same time. You may only ask for HAG if you are applying for permanent resident status in Canada or a permanent resident visa abroad. We will not look at H&C requests from temporary resident applicants. You cannot apply for HAG if you have a pending refugee claim. If you want to apply, you must withdraw your refugee claim before your Immigration and Refugee Board of Canada (IRB) hearing. You cannot apply for HAG if you had a negative decision from the IRB within the last 12 months. This is called the “one-year bar.” (If the IRB decides your refugee claim is abandoned or withdrawn, that counts as a negative decision.) The bar does not apply if: you have children under 18 who would be adversely affected if you were removed from Canada, or you have proof that you or one of your dependents suffers from a life-threatening medical condition that cannot be treated in your home country. Final thoughts, people who would not normally be eligible to become permanent residents of Canada may be able to apply on humanitarian and compassionate grounds. Canada updated Instructions for the Spouse or Common-Law Partner in Canada Class

Instructions for the Spouse or Common-Law Partner in Canada Class Updated

On June 8, 2022, the Government of Canada updated instructions regarding determining membership in the spouse or common-law partner in the Canada class. The revised instructions for circumstances when there is a relationship breakdown and the primary applicant (sponsored spouse) wishes to proceed with their permanent residence application.  The conversion to humanitarian and compassionate grounds is applicable for these cases. In addition, the instructions have been updated to include further clarification on these cases under the exemption from the requirement to have temporary resident status. The foreign national meets the membership requirements of the spouse or common-law partner in the Canadian class if all of the following apply if they: are the spouse or common-law partner of a sponsor (as defined in R130) and cohabit with that sponsor in Canada (Common-law partners must have cohabited for at least one year) have temporary resident status  are the subject of a sponsorship application if they are not excluded from the class under R125 concerning excluded relationships   Lawful temporary resident status in Canada To become members of the class for eligibility, applicants in the spouse or common-law partner in Canada class must have valid temporary resident status on the date of application and on the date they receive permanent resident status. Exemption from requirement to have temporary resident status The spousal public policy facilitates the processing of genuine out-of-status spouses or common-law partners in the spouse or common-law partner in the Canada class who meet the other eligibility requirements of the class. Applicants who are covered under the public policy should be processed according to the provisions of the spousal public policy. Applicants who do not have temporary resident status and who are not eligible under the spousal public policy can be removed at any time. Further, the spousal policy does not change the requirement to seek necessary authorization to visit Canada or to work or study here. If the applicant cannot be exempted from the legal temporary resident status requirement under the spousal public policy they may request an exemption from the requirement to have temporary resident status in Canada on Humanitarian and compassionate grounds. See Humanitarian and Compassionate considerations for applicants in the spouse or common-law partner in Canada class. Public policy cases where the relationship is ongoing but the applicant has been deported or where the applicant and sponsor are in an excluded relationship (for example, R4, R5, R125 (1) (d)) should not result in the application being converted to a humanitarian and compassionate in-Canada application. Instead, these humanitarian and compassionate grounds requests should be considered in the context of the spouse or common-law partner in Canada class.   Temporary resident requirement in Canada Other requirements applicable to a foreign national, who apply to remain in Canada as a member of the Spouse or Common-law Partner in Canada Class: a foreign national is not considered a spouse or common-law partner if the marriage or common-law partnership is not genuine or was entered into primarily for the purpose of acquiring any status or privilege under the Act [R4] a foreign national is not considered a spouse or common-law partner if a new conjugal relationship was begun after a previous marriage or common-law partnership with that person was dissolved primarily to acquire any status or privilege under IRPA [R4.1] a foreign national must not be the subject of enforcement proceedings or a removal order for reasons other than “lack of status” (see definition of “lack of status” under the spousal public policy). Although most persons who are under a removal order or facing enforcement proceedings for reasons other than “lack of status” are eligible for initial consideration under the public policy as they meet the criteria in R124, they cannot be granted permanent residence as they will be found inadmissible in the second stage of processing a foreign national becomes a permanent resident if they meet the requirements of R72 a foreign national and their family members must meet admissibility requirements (R72), however, they are exempt from inadmissibility on health grounds due to excessive demand on health and social services a foreign national must have a valid passport or travel document by the time permanent residence is granted (R72) Noted: “Lack of status” may also refer to persons who have overstayed a temporary resident permit. IRCC Invited 932 Candidates through Express Entry

IRCC Invited 932 Candidates through Express Entry

IRCC Invited 932 Candidates through Express Entry On June 8, 2022, Immigration, Refugees and Citizenship Canada (IRCC) issued 932 Invitations to Apply (ITA) to candidates under the Provincial Nominee Program (PNP) in the new PNP-targeted draw. In round #224, the cut-off score was 796 points, 55 points more compared to the previous PNP draw.  The tie-breaking rule for this round was October 10, 2021, at 17:13:17 UTC. As of June 3, 2022, there are 215,316 profiles registered in the Express Entry pool, 4,223 fewer compared to the previous update. In 2022, Canada issued 10,152 ITAs through Express Entry. IRCC issued a record 114,431 ITAs in 2021, all to Canadian Experience Class (CEC) and PNP candidates. It beat the previous record of 107,350 set in 2020. The newest draw saw the tie-breaking rule implemented on October 10, 2021, at 1.13 pm EST. If more than one candidate had the minimum CRS score, only those who had submitted their Express Entry profiles before this date and time received invitations.  Canada holds another PNP-specific draw. This is the largest round of invitations to be held since March this year. Express Entry Draw #224 – June 8, 2022 Invitations issued 932 Invited from Provincial Nominee Program (PNP) Minimum score cutoff CRS 796 In 2022 so far –               ●    Total draws: 12               ●    Total invitations: 10,152 IRCC Invited 932 Candidates through Express Entry Immigration, Refugees, and Citizenship Canada have been focused on clearing the present significant backlog before it resumes issuing ITAs in larger numbers.   Canada Has So far Issued 9,365 Invitations, All to PNP Candidates, in 2022 This is the highest-ranked based on its scores allotted on the invited 1,200-point Comprehensive Ranking System (CRS) matrix. As on June 6, 2022, there were a total of 215,316 profiles in the IRCC Express Entry pool of candidates. Of these, only 922 were in the CRS 601 to 1,200 ranges. A nomination through any of the Express Entry linked streams under the PNP (Provincial Nominee Program) is worth CRS 600 ‘extra’ points. With the CRS 600 points for PNP nomination alone, Provincial Nominee Program-specific Express Entry rounds generally tend to have a higher minimum CRS requirement. For example, the lowest CRS score required is 796 in the latest Express Entry draw. If you take into account CRS 600 points of PNP nomination, the human capital factor score would have been only 196. The new 16 occupations to be eligible for Express Entry National Occupational Classification (NOC) 2021 will come into effect in November, allowing the following 16 occupations to become eligible for Express Entry: Dental assistants and dental laboratory assistants; Payroll administrators; Nurse aides, orderlies, and patient service associates; Pharmacy technical assistants and pharmacy assistants; Elementary and secondary school teacher assistants; Sheriffs and bailiffs; Correctional service officers; By-law enforcement and other regulatory officers; Estheticians, electrologists, and related occupations; Residential and commercial installers and servicers; Pest controllers and fumigators; Transport truck drivers; Other repairers and services; Bus drivers, subway operators, and other transit operators; Heavy equipment operators; and Aircraft assemblers and aircraft assembly inspectors. Canada Introduced Changes to the Super Visa program

Changes in the Super Visa Program Canada 2022

On June 7, 2022, Sean Fraser, Minister of Immigration, Refugees and Citizenship Canada (IRCC) announced changes to the Super Visa program, making it easier for Canadians to reunite with their parents and grandparents. The new amendments will come into force on July 4, 2022, and allow super visa holders to stay in Canada for a longer period of time. The super visa holders will be able to stay in Canada for 5 years per entry and request to extend their stay by up to 2 years. In addition, international medical insurance companies also will be allowed to provide the necessary medical coverage for super visa applicants. The changes will come into effect in Super Visa Program on July 4, 2022 The length of stay for Super Visa holders will be increased to five years per entry into Canada. Applicants who currently have a Super Visa also have the option to request to extend their stay by up to two years while in Canada. It means current Super Visa holders will now be able to stay in Canada for up to seven straight years. Canada’s IRCC Immigration Minister will have the authority to designate international medical insurance companies to provide coverage to Super Visa applicants in the future. For over a decade, the Super Visa has been offered as an alternative to the PGP. The Parents and Grandparents Program offers permanent residence, but due to its popularity, the demand to sponsor far exceeds the number of places available. The super visa has remained a popular and accessible option for Canadian citizens and permanent residents to reunite with their parents and grandparents in Canada. Each year, IRCC issues approximately 17,000 super visas.  Valuable Facts of the Super Visa Program The most valuable facts about Canada’s Introduced Changes to the Super Visa Program are: To sufficiently support super visa holders while in Canada, their host child or grandchild must meet minimum income requirements. Further, parents and grandparents applying for a super visa must have a medical examination and provide proof of private health insurance from an approved insurance provider. This is to ensure that medical costs will be covered for the super visa holders so that the cost of those services does not fall upon Canadian taxpayers. This alert is only for informational purposes.
