On May 9, 2023, the Government of Canada published new instructions for in-Canada study permit applications. The changes were designed to make it easier for protected persons and their families to stay in Canada and pursue their educational goals.  The new instructions allow protected persons and their family members to apply for a study permit from within Canada, regardless of whether they have already applied for in-Canada permanent residence. Previously, protected persons and their families could apply for a study permit if they were in Canada permanent residence applicants.   What is a Study Permit? Canada issued the study permit, allowing foreign nationals to participate in studies at Canadian-designated learning institutions (DLIs). To study in Canada, the majority of foreign nationals require a study permit. Before applying, make sure you have all the required documents. Applying is a must before entering Canada. A visa is not what your study authorization is. You cannot enter Canada with it. You could also require an electronic travel authorization (eTA) or a guest visa.   Study Permits Eligibility Requirements from outside of Canada To be eligible to submit an application for a study permit, you must meet the following requirements: Acceptance Letter: In order to apply for a Canadian study permit, you must have an acceptance letter from a Designated Learning Institution (DLI). Proof of Funds for financial support: You must submit documents showing that you have sufficient funds to pay for your first year’s tuition as well as the costs of living (housing, food, etc.) for you and any accompanying family members.  Supporting Documents: All applications for study permits must be submitted with an extensive list of supporting documents. India remains the primary source of newcomers to Canada, accounting for over a quarter (25%) of all permanent residents in the country.  Last year, 118,095 Indians landed as permanent residents - an impressive six-fold increase compared to Canada’s second-highest source country for new immigrants - China. The Conference Board released a report recommending boosting PNP slots for international students. The Conference Board of Canada has announced that Canada could see an increase in international student immigration if the provinces could nominate more students through Provincial Nominee Programs (PNP). Without access to government-supported settlement services, international students are managing the transition to the labor market and the immigration system, according to the Conference Board of Canada” “By ensuring that international students receive help from their post-secondary institution and from provincially supported settlement services, provinces can increase retention”   Rankings of Canadian Universities Canada’s colleges and universities are known for their excellent global reputation. Three Canadian universities—the University of Toronto (UofT), the University of British Columbia (UBC), and McGill University—placed among the top 100 in the ninth annual Best Global Universities ranking of 2,000 of these educational institutions worldwide. Additionally, 15 more Canadian universities made it into the top 25 of the list of the top 2,000 universities. The University of Toronto came in at number eighteen. UBC came in 35th. The third-best university in Canada is McGill University. With 418,260 international students getting a study permit in the first nine months of this year, according to IRCC data, Canada is on track to break its previous record for study permits issued. If the current process continues, Canada may end this year with 557,680 study permits issued. That would be 113,200 more study permits than were given last year (444,480), or over 25.5% more. With a rise from 219,035 in 2015 to record-breaking levels today, the number of study permits awarded to foreign students entering Canada has more than doubled since that year. Once granted, a study permit enables a foreign individual to pursue their academic goals in Canada at an approved institution for the duration of the specified course or program.   There are some exceptions. Under the following circumstances, foreign people may attend school in Canada without needing a study permit: the academic course or program is shorter than six months in length; The student is either an employee or family member of a foreign representative in Canada or; The student serves in a foreign military.   Students who want to study in Canada must: have received acceptance from a Canadian school, college, university, or other educational organization. have demonstrated they have the financial means to cover their living expenses, tuition fees, and any additional family members they wish to bring to Canada with them. be law-abiding persons without a criminal history who do not pose a threat to Canada’s security. They can be required to offer a police certificate. be in good health and ready, if required, to undergo a medical examination. convince an immigration officer that they will depart Canada after their permitted stay is over.   International Students With Study Permits Are Allowed To Work In Canada If the student is from a nation from which such visas are required for entry into Canada, a Temporary Resident Visa (TRV) may also be required. Visa-exempt nationals are exempt from this requirement.   Students are allowed to work during their studies in Canada by Immigration, Refugees, and Citizenship Canada (IRCC). Under the following circumstances, a student may be allowed to work in Canada while they are studying: without a Work Permit on campus. with a work permit, off campus. with a work permit in co-op and internship programs, where practical experience is a requirement for admission.   For the period of the study permit, foreign students’ spouses or common-law partners are also eligible for employment permits. A foreign student may use the Post-Graduation Work Permit Program to apply for a work permit after graduating. Canada published temporary public policy details allowing students to work more than 20 hours per week On November 22, 2022, the Canadian Government released the instructions for the temporary public policy that lifts the work limitation of study permit holders. International students that were allowed to work without a work permit for no more than 20 hours during regular academic sessions can do so under this public policy.    The policy came into effect on November 15, 2022, and will expire on December 31, 2023. Canada introduced this policy to allow international students to gain valuable work experience in Canada and solve the labor shortage problem in Canada.   Background of Consideration The Canadian economy is experiencing a labor shortage which might affect one million jobs, according to employers. In order to temporarily meet these labor market requirements, allowing international students to work more than 20 hours per week while enrolled in classes will be beneficial.   Public policy Considerations This public policy will enable eligible foreign nationals who are studying full-time in Canada and who either hold a study permit or have applied to renew their study permit and are authorized to study under Section 189 of the Regulations to work off-campus without a work permit for even more than 20 hours per week throughout regular academic sessions between November 15, 2022, and December 31, 2023. (or until this public policy is revoked, whichever comes first). The foreign national’s study permit application must have been received by IRCC on or before October 7, 2022, in order to qualify for this public policy.   It is hereby established that there are significant public policy factors supporting the granting of exemptions from the Regulations’ requirements to foreign nationals who meet the set standards in accordance with section 25.2 of the Act.   Eligibility Requirements Delegated officers may issue an exemption from the regulations’ requirements based on public policy considerations if International Students:   holds a study permit that is currently valid, and the application for that permit was submitted to IRCC on or before October 7, 2022; submitted a renewal application for their study visa before it expired in accordance with subsection 217(1) of the Regulations, and the IRCC received the such application on or before October 7, 2022; in accordance with section 189 of the Regulations, is permitted to study without study permission; is enrolled full-time at a designated learning institution; and is enrolled in an academic, vocational, or professional training program at the post-secondary level that is offered in Quebec, in each case with a duration of at least six months and leading to a degree, diploma, or certificate.   This program gives many overseas students greater chances to gain valuable work experience in Canada, which will boost the labor pool available to support Canada’s post-pandemic growth.   The majority of international post-secondary students have the right to work both on and off campus, and this freedom is expressly stated on their study permits. International students can work full-time in Canada until the end of 2023 Currently, international students in Canada can work full-time during the academic year. Last month, Immigration Refugees and Citizenship Canada (IRCC) announced this temporary measure allowing international students to work more than 20 hours a week between November 15, 2022, and December 31, 2023.  IRCC introduced this measure to help with Canada’s severe labor shortages in retail, hospitality, food services, etc. Around 500,000 international students already in Canada are expected to work more hours with no restrictions on the type of employment. International students in Canada with a study permit were typically limited to working 20 hours per week.. However, those limits have been temporarily removed by the IRCC, so students can work as many hours as they like until at least the end of 2023.   This statement has been welcomed by the higher education community. Current international students are also happy about it because it gives them more possibilities and significantly more flexible work hours. Many people are hoping that the Canadian government would make this decision permanent even though it is being referred to as a trial project.   Eligibility for Working Hours in Canada You are allowed to work while studying in Canada if you:   carry a present study permit; are enrolled full-time in a recognized educational institution. have enrolled in classes and continue to keep a satisfactory academic status as defined by your institution; are enrolled in a bachelor’s course that is at least six months or a professional training program that results in a diploma or certificate;  and hold a Social Security Number (SIN)   This program gives many overseas students greater chances to gain valuable work experience in Canada, which will boost the labor pool available to support Canada’s post-pandemic growth.   The majority of international post-secondary students have the right to work both on and off campus, and this freedom is expressly stated on their study permits. Canada has the largest immigrant share of the population in over 150 years On October 26, 2022, Statistics Canada published the sixth round of the Census data report, announcing that immigrants made up almost a fourth of the Canadian population, which is the largest share in over 150 years.    Statistics show that as of 2021, 8.3 million people in Canada were landed immigrants or permanent residents, which is about 23% of the population.    This number has increased since the Confederation and is currently the highest among all G7 countries. As the Canadian population ages and fertility levels are below the population replacement level, immigration becomes Canada’s primary driver for population growth.   The highest percentage of immigrants among the G7 In 2021, about a quarter (23%) of the population, or more than 8.3 million people, were or had ever been landed immigrants or permanent residents in Canada, according to the report. This was the highest percentage among the G7 and the biggest percentage since the Confederation, breaking the previous record of 22.3% set in 1921.   Four-fifths of the increase in the labor force from 2016 to 2021 was due to immigration. In the same period, the number of people living in private households in Canada increased by 5.4%, with new or recent immigrants contributing 71.1% of that rise. The survey also predicts that, if current trends hold, immigrants might make up as much as 29.1% of Canada’s population by 2041.   In Canada, more than half of recent immigrants were accepted under the economic category.
